Terms and Conditions
1. These Terms and Conditions govern Colman’s Social Media Giveaway (“Promotion”) and apply to you so far as the law permits, so please read them carefully.
2. This Promotion is open to residents of United Kingdom aged 18 or over, except employees of the Promoter, their families, agents, or anyone professionally connected with the Promotion.
3. To enter, the entrant must:
a) Log onto your Instagram account (or create one for free);
b) follow @colmansuk on Instagram;
c) Like @colmansuk Instagram Promotional Post posted on 14/11/2024
d) Comment underneath the @colmansuk Promotional Post with the words “Hello Hot Stuff” and tag 1 x friend.
4. The opening date for entries is 16:45 GMT on 14/11/2024 and the closing date for receipt of entries is 09:00 GMT on 18/11/2024.
5. The Promotion is limited to one entry per Instagram account.
6. You must keep your profile on a public setting and continue to follow the @colmansuk official Instagram accounts for one month after the closing date in order to be contacted if you are selected as a winner.
7. No purchase necessary; however, internet access and a valid Instagram account are required.
8. No applications from agents, third parties, organised groups or applications automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted. Any entrant found to be using multiple Instagram accounts to enter will be ineligible. Entries will only be accepted if they comply with all these Terms and Conditions.
9. Each entry:
a) must be suitable for display and publication online and should not be obscene or indecent (including but not limited to nudity, pornography, or profanity), it must not contain defamatory statements or words or symbols that are offensive either generally or to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group. It must not include threats to any person, place, business or group, it must not invade privacy or other rights of any person, firm or entity, and it must not in any other way violate applicable laws and regulations or network standards;
b) Entries received in connection with this Promotion will be reviewed by the Promoter or a third-party moderator after they have been placed online to confirm that they comply with these Terms and Conditions. If any such entries/comments are or could reasonably be construed as being unlawful or offensive or contrary to these Terms and Conditions and or against the network guidelines, we reserve the right to remove them from the Promotion post on Colman’s Instagram page immediately at any time without prior notice to entrants.
10. By participating in this Promotion, you agree to release, discharge, and hold us harmless from any and all injuries, liability, losses and damages of any kind resulting from your participation in this Promotion (save that nothing shall limit our liability for fraud, or for death or personal injury caused by our negligence).
11. Entrants shall indemnify and hold the Promoter and their respective affiliates, directors, agents, or other partners ("the Indemnitees") harmless from any claims, actions, proceedings, costs (including reasonable legal fees) and expenses brought or asserted by a third party against any of the Indemnitees arising as a result of the Promoter's use of the entrant's submission including but not limited to any breach of third party intellectual property rights
12. Responsibility is not accepted for entries lost, damaged, or delayed as a result of any network, computer hardware or software failure of any kind.
13. There is one (1) prize in total. The winner will receive 1 x limited edition Colman’s “Hello Hot Stuff” apron, and 1 x jar of Colman’s Mustard 70g. Prizes subject to stock/availability.
14. There will be one (1) winner. The winner will win 1 x box containing:
a) 1 x Limited Edition Colman’s Mustard “Hello Hot Stuff” apron
b) 1 x Colman’s Mustard jar 70g
15. All valid entries received through Instagram on or before the closing date will be assigned a number in order of entry and the winning number will be selected by a random number generator. The first entry drawn at random will win the prize. In the event of any dispute, the Promoter's decision is final. In the event of unforeseen circumstances, the Promoter reserves the right to substitute the prize for an alternative of equal or greater value. No correspondence will be entered into.
16. The prize is as aforementioned in Clause 12 and no cash or other alternatives shall be offered. The prize is non-exchangeable, non-refundable and are not transferable. The products included within the prize will also be subject to stock/availability. The prize may not be resold under any circumstances.
17. The winners will be notified by an Instagram direct message from the @colmansuk account within 10 days of the closing date. The winners must claim their prize by responding to the direct message with their full name, address, and contact number within 14 days of this direct message. If the prize is unclaimed after this time, it will lapse, and the Promoter reserves the right to offer the unclaimed prize to a substitute winner selected in accordance with the promotion rules.
18. The Promoter may publish the winner’s information (surname and county) to confirm that the prize was properly awarded. The winners’ details (surname and county) may be made available on request by emailing ColmansSocial@outlook.com within 30 days after the Closing Date. The winners have the right to object to disclosure of their details and they can notify the Promoter if they do not wish for this information to be published, by responding within 7 calendar days to the email notifying them that they have won a prize.
19. This promotion is not sponsored, endorsed, administered by, or associated with Meta or Instagram. Entrants are providing information to the Promoter and not to Meta or Instagram. Entrants release Meta and Instagram for all claims and liabilities arising in respect of the promotion.
20. By entering the promotion, all entrants will be deemed to have accepted and be bound by the rules and consent to the transfer of their personal data to the Data Controller for the purposes of the administration of this promotion and any other purposes to which the entrant has consented. The personal data will be processed in accordance with the Data Controller’s Privacy Policy, which is available at https://www.unilevernotices.com/privacy-notices/united-kingdom-english.html. All entry instructions form part of the rules.
21. These terms and conditions and any issues or disputes which may arise out of or in connection with these terms and conditions (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with English law. Entrants hereby irrevocably submit to the exclusive jurisdiction of the English courts to settle any such dispute or issues.
